In New Jersey, endangering the welfare of a child is a serious criminal offense. Child endangerment in New Jersey can take the form of sexual or non-sexual offenses. Either type can put the offender’s freedom at serious legal jeopardy.
Not only could a conviction put a person in jail or on probation, but also a conviction could make it more challenging to find a job or housing. These collateral consequences can wreak havoc on an offender’s future life. To combat these legal issues, anyone alleged to have committed the criminal act of endangering the welfare of a child needs to speak with an experienced criminal defense lawyer right away.
What Constitutes Endangering the Welfare of a Child?
Under New Jersey law, a person can endanger the welfare of a child by engaging in sexual conduct with a minor or abusing or neglecting a child in a non-sexual manner. Although sexual conduct is not defined, sexual assault, engaging in sexual activity, kissing, and other acts of lewdness in the pr

The Nature and Severity of Specified Offenses
Over the past couple of years, immigration denial decisions regarding Adam Walsh Act (AWA) waivers coming from the USCIS have been remarkably short. USCIS adjudicating officers recite an accounting of the evidence to let the petitioner know it was reviewed and not skipped....

Many believe that victimless crimes do not require an Adam Walsh Act immigration waiver, or that a waiver should be easy to approve because there was no victim. This is incorrect. Anyone who has a specified offense involving a minor child is subject to the AWA, victim or no victim. There is no exception, and the path to success is difficult in every case....
Immigration Consequences of the Adam Walsh Act
When you marry someone from another country, your wife must normally go through immigration processing in order to become a permanent resident in the US. Part of this process includes reviewing any charges or criminal convictions either of you have. An Adam Walsh Act Waiver is required if you are a registered sex offender and the victim was a minor child under 18 years of age...

Abstract:
Under the doctrine of qualified immunity, public officials are held to a much lower standard. They can be held accountable only insofar as they violate rights that are “clearly established” in light of existing case law. This standard shields law enforcement, in particular, from innumerable constitutional violations each year. In the Supreme Court’s own words, it protects “all but the plainly incompetent or those who knowingly violate the law.” It is under this rule that officers can, without worry, drag a nonthreatening, seven months pregnant woman into the street and tase her three times for refusing to sign a piece of paper...

The information that states typically collect about the sex offenders includes the offender's name, address, picture, and the nature of their crime. States publish this information on freely available web sites that the public can query in many different way.
