You understand that participation in the Activities includes, physical and mental activities and exercises, participating with other participants, contact with unfamiliar persons, participating in new and unfamiliar places, exposure to risks in the areas where the activities are conducted, and exposure to communicable diseases (including COVID-19 risks). You fully understand that the activities can be HAZARDOUS, and involve known and unanticipated risks which could result in BODILY OR MENTAL INJURY, ILLNESS, DEATH, DAMAGE OR LOSS to yourself, your property and you fully accept and ASSUME ALL SUCH RISKS and all responsibility for losses, costs, and damages you or any third parties incur as a result of your participation in the activities, including property theft. You represent that you are participating in the activities voluntarily and that you are in good health, physically and mentally fit, and otherwise prepared and able to participate in the activities. You agree that you will discontinue participation in the activities if you believe at any time your participation poses a threat to yourself or any third party. If you have any injury or condition that potentially affects your participation in the activities, you will consult with your physician or other applicable providers regarding your participation, and follow all applicable provider instructions, which is your sole responsibility. In consideration of permission to use, today and on all future dates the property, facilities, and services of Yoga Moves Us. I on behalf of myself, my heirs, personal representatives, or assigns, do hereby release, waive, discharge, and covenant not to sue Yoga Moves Us and or the City Of Sacramento, City of Davis, Old Sacramento, Free Day of Yoga businesses, End of Summer Celebration partners, employees, volunteers, independent contractors, the property owner and agents from liability from any and all claims against them. This agreement applies to 1) personal injury (including death) from accidents or illnesses arising from the participation in physical or ordinary activities, including but not limited to, organized activities, classes, observation, and individual use of facilities, premises, or equipment; 2) any and all claims resulting from the damage to, loss of or theft of property. and also 3) photos, videos, and any other forms of marketing that Yoga Moves Us have of you for a class or event you have attended. Acknowledgment of Understanding: I have read this Release, waiver of liability, assumption of risks, indemnification, and fully understand its terms and my assumption of risks involved. I understand I am giving up substantial rights, including my right to sue. I acknowledge that I am signing the agreement freely and voluntarily, and intend my signature to be a complete and unconditional release of all liability to the greatest extent allowed by law in the State of California. If the participant is under 18 years, parent or legal guardian must sign this waiver. By attending this event you grant the event organizers full rights to use the images resulting from the photography/video filming, and any reproductions or adaptions of the images for social media, press releases, and fundraising opportunities.
